Experience

David Pierce, founder and principal of Pierce Construction Law, is a seasoned construction litigation attorney with more than three decades of construction litigation experience, over 300 construction depositions under his belt, dozens of arbitrations and mediations and trials, and decades of experience with construction Case Management Orders. For more than 20 years Mr. Pierce was a senior member of the preeminent construction defect firm of Castro & Associates, until the untimely passing of Joel Castro in 2019, and Pierce Construction Law was formed. Along with other members of Castro & Associates, Mr. Pierce helped earn the Martindale Hubble “AV” rating for the highest ethical standards and legal ability, the pinnacle of “professional excellence.”

For more than 30 years, Mr. Pierce has handled all aspects of complex construction which he began at the well-known insurance defense law firm of Spray Gould and Bowers and continued with nearly 20 years at Castro & Associates. He has represented a broad scope of construction entities including developers, general contractors, subcontractors for most construction trades. He has also represented home/property owners, contractors, and design professionals. Mr. Pierce has a strong background in construction defect litigation. He worked for almost 5 years as lead counsel for the general contractor in multiple related cases with dozens of parties in Santa Clarita, which resulted in a $20 million dollar settlement.

In other firms preceding Castro & Associates, Mr. Pierce has had a varied litigation practice that included business interference tort cases, insurance bad faith claims, condemnation, real estate transactions and governmental tort claim liability and tort claims acts. He has represented various governmental entities, including, the County of Ventura, Public Works Departments, Transportation Departments, Environmental Health and Sheriffs Departments for Ventura and Santa Barbara Counties. Mr. Pierce was a member of the prominent environmental law firm, Haines, Russ, McMurry & De Recat, where he handled environmental clean up litigation and co-authored a chapter on the definitive treatise on Eminent Domain, found in every California law library.

Mr. Pierce is well versed in protocols of governmental funding, procurement, management and service as he has spent 10 years as an Environmental Health Officer for Santa Barbara County, directing countywide programs for the regulation and enforcement of environmental issues, including water and food safety, wastewater, land use, and hazardous materials. He regularly appeared before regulatory agencies and legislative bodies at all levels and before he left for a law practice, was the Acting Director of Environmental Health for Santa Barbara County.

David H. Pierce is licensed to practice in all courts of the State of California, the U.S. District Court, Central District of California, and is a member of the Los Angeles County Bar Association; the American Bar Association; and the California Trial Lawyers Association.

Education

David H Pierce attended UCLA, earning a Bachelor’s degree in Psychology in 1971. In 1974 he received a Master’s degree.in Environmental Health Science from California State University, Northridge. He earned his doctorate in 1984 from the Southern California Institute of Law at Santa Barbara.
